1. The Service

Aikakone is a free, AI-powered watch registry platform that helps users catalog, track, and verify their watch collections. The Service includes web application access, watch data management, AI-powered tools, and related features available at aikakone.io.

2. Accounts

To use Aikakone, you must create an account. By creating an account, you agree:

• You are at least 16 years old
• You will provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activity that occurs under your account
• You will use only one account (no duplicate accounts)
• You will not impersonate another person or provide false information

3. User content

You retain full ownership of all content you upload to Aikakone, including watch photos, descriptions, and data (collectively, "User Content").

By uploading User Content, you grant Aikakone a worldwide, royalty-free, non-exclusive license to:

• Display and store your content within your account
• Process and analyze your data to provide and improve the Service
• Use aggregated, anonymized data for analytics and product development

You remain the sole owner of your User Content and may delete it at any time.

4. Acceptable use

You agree not to use Aikakone for any of the following purposes:

• Creating fake or misleading listings of watches
• Listing stolen property or facilitating the sale of illegal items
• Harassing, threatening, or abusing other users
• Scraping, crawling, or automated access to the Service without permission
• Reverse engineering or attempting to access the Service's underlying technology
• Uploading malware, viruses, or harmful code
• Circumventing security measures or access controls

Violation of these terms may result in account suspension or termination.

5. AI-generated content and tools

Aikakone provides AI-powered features including serial dating, market valuation, stolen watch screening, and content generation. Regarding these features:

• AI-generated estimates (serial dates, market values) are informational only and are not professional appraisals
• Stolen watch screening results are advisory and do not constitute legal proof of theft or legitimacy
• AI-generated content (articles, insights) is clearly labeled and may contain inaccuracies
• You should independently verify any AI-generated information before making decisions of legal or financial significance
• We continuously improve our AI models but do not guarantee their accuracy or completeness

For valuable or high-end watches, we always recommend seeking professional authentication from a certified watchmaker or appraiser.

6. Verification disclaimer

Aikakone provides tools and features to help users track and verify watches in their personal collections. However:

• We do not guarantee the authenticity of any watch listed on our platform
• Our verification tools are not a substitute for professional appraisal or authentication
• Users are solely responsible for the accuracy and legality of their listings
• We are not liable for disputes arising from watch authenticity or condition

7. Fees and subscriptions

Aikakone offers a free tier with core features. We may offer optional paid plans with additional features.

For paid plans:

• Fees are billed monthly or annually, depending on your chosen plan
• Billing occurs on the date you subscribe and on each subsequent billing anniversary
• You can cancel your subscription anytime, and cancellation takes effect at the end of the current billing period
• Refunds are not provided for partial months unless required by applicable consumer protection law

8. Intellectual property

Aikakone and all of its original content, features, and functionality (including but not limited to design, text, graphics, logos, and code) are owned by Aikakone and protected by international copyright, trademark, and other intellectual property laws.

User Content remains your property. All other content on Aikakone is our property or the property of our licensors.

9. Limitation of liability

To the fullest extent permitted by law:

• Aikakone is provided "as is" without warranties of any kind, express or implied
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability for any claim shall not exceed the greater of the amount you have paid to us in the 12 months preceding the claim or EUR 50
• We are not responsible for data loss, service interruptions, or third-party actions

Nothing in these terms limits liability for fraud, gross negligence, or any liability that cannot be excluded by law. Your statutory consumer rights under EU law remain unaffected.

10. Termination

Either you or Aikakone may terminate your account and use of the Service at any time.

Upon termination:

• Your account and all associated data will be disabled and you will lose access to the Service
• You may request data export or deletion in accordance with our Privacy Policy
• Provisions that by their nature should survive termination (intellectual property, limitation of liability, dispute resolution) will continue in effect

11. Dispute resolution

If you have a dispute with Aikakone, we encourage you to contact us first at hello@aikakone.io so we can try to resolve it directly. Most concerns can be addressed quickly.

If you are a consumer in the European Union, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12. Governing law

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Amsterdam, Netherlands for the resolution of any disputes. This does not affect any mandatory consumer protection rights you may have under the laws of your country of residence.

13. Changes to these terms

We may update these Terms of Service from time to time. Material changes will be communicated to you via email at least 30 days before they take effect. Your continued use of Aikakone after the effective date constitutes your acceptance of the updated terms. If you do not accept the new terms, you may terminate your account.
